The RACT, The Fund's assessment panel and the appointers of The Fund's assessment panel will not be liable in relation to any claims, losses, costs or expenses incurred by any applicant (nor any third party who may consider themselves to be relying on an applicants application) in relation to any aspect of the loan application process or assessment, nor any delays to an applicant's project due to the application process. The decision of The Fund's assessment panel will be final.
Loans from The Fund will be allocated in a series of rounds and in order to be eligible for consideration for a particular round a completed application form along with all required enclosures must be submitted prior to the application deadline. Where such documentation is not provided by the application deadline the application will be held over until the next available round, assuming funds remain within The Fund for further allocations. The project business case and cash flows may require updating where an application is held over.
All information about applicants, proposed projects and the findings of The Fund's assessment panel will remain confidential. However, due to the nature of The Fund, successful loans will be publicised, as will the ongoing performance of projects that received a loan through The Fund.
Should an applicant object to RACT assisting and/or administering their application for a loan from The Fund, they should raise their issue within the Expression of Interest form and alternative arrangements will be considered. However, as administrators of The Fund, RACT will process all payments and receipts from and to The Fund.
