Online Terms & Conditions

These online terms and conditions apply to the online sites of the RACT Group and how it operates and regulates its online sites and social media sites (Online Sites).

The RACT Group is the name given to the group of companies that trade under the RACT Brand owned by The Royal Automobile Club of Tasmania Limited ABN 62 009 475 861 (the Club) and in relation to this document includes the Club, RACT Insurance Pty Ltd ABN 96 068 167 804, Members Travel Group Pty Ltd (trading as RACT Travel) ABN 45 144 538 803 (RACT Travel) and RACT AutoServe Pty Ltd ABN 49 158 958 911.

By using our online sites and the Services and information offered on our online sites, you are agreeing to these terms and conditions.

If you purchase products through our online sites, there will be additional terms and conditions relating to those products (including product disclosure statements where applicable) and the purchase. Please make sure you agree with these terms and conditions, which you will be directed to read prior to making any purchase.

We try and make all reasonable efforts to ensure that the information we provide on this Website is current and accurate, however, the information is for general information purposes only and we make no guarantee, and we accept any legal liability arising from or connected to, the accuracy, reliability, currency or completeness of anything contained on our Online Sites or on any linked site.

We take considerable effort to ensure that our IT Security practices are robust and contemporary however we make no representation that our Online Sites are virus free nor that any email you send to us through Our Sites cannot be intercepted and we accept no liability for any damages resulting from your use of the Online Sites due to malicious third party actions.

RACT makes no representation in relation to and does not warrant that the Online Sites or functions available on the Online Sites will be interruption free. The Online Sites are offered on an “as is” and “as available” basis only.

Indemnity

You indemnify any and all members of the RACT Group in respect of any liability incurred by you or the RACT Group for any loss, cost, damage or expense, howsoever caused, as a result of you use of the Online Sites or your breach of these online terms.

Limit Liability

RACT does not exclude any rights and remedies available to you n terms of the Australian Competition and Consumer Law (Cth) or any similar State or Territory legislation in relation to the provision by us of any goods or services via the Online Sites which cannot be excluded, restricted or modified. Otherwise we exclude all conditions and warranties which may be implied by law.

To the extent any implied warranty or condition which cannot be excluded our liability is restricted at our option to the: resupply, repair or the cost of resupply/repair of those goods or services.

You agree that in no circumstances will we be liable to you to any indirect, incidental or consequential losses or damages or loss of profits of whatever nature howsoever arising due to your use of or in connection with the Online Sites.

Termination of Use

Your access to the Online Sites may be terminated by the RACT Group. You may terminate your use of the Online Sites at any time. However any and all restrictions, licences or indemnities granted by you, and all disclaimers and exclusions of and limitations on liability on RACT, will survive any termination. Upon termination you must not directly or indirectly access or use the Online Sites or use any content on the Online Sites.

Unacceptable Use

You must not use the Online Sites or the content of the Online Sites in any manner or for any purpose that is unlawful or in any manner which violates these online terms. You agree to abide by all applicable laws and regulations and codes of conduct.

In particular you agree not to:

  • Use the Online Sites for any reason other than for a purpose as a valid customer or for a non-commercial purpose;

  • Use the Online Sites to offend, disparage, threaten, stalk or harass others;

  • Engage in or promote any surveys, contests pyramid schemes or unsolicited emailing via the Online Sites;

  • Impersonate any individual or entity;

  • Do anything which might disrupt access or interfere or cause damage to/with the Online Sites including any use of automated tools; or

  • Take any action that reverse engineers or reveals source code or other processes connected with the Online Sites.

Publication of electronic addresses on the Online Sites is for the purpose of member or customer communication only and must not be used to infer consent to the receipt of unsolicited commercial electronic messages or viruses. The sending of unsolicited commercial electronic messages to RACT, the infection of a virus or other computer codes, files or programs designed to interrupt, limit or destroy the functionality of other computer software or hardware in RACT’s systems by accessing the Online Sites is regarded by us as a breach of these online terms and RACT reserves its right to take any appropriate action it deems necessary (which may include legal action or provision of information to law enforcement agencies)

Unauthorised linking to any part of the Online Sites (including Social Media Sites operated by a member of the RACT Group) is expressly prohibited. Authorisation in writing by the RACT Group is required to link to any part of the Online Sites. Please contact us if you would like to link to any part of the Online Sites.

Online Transactions

Applications for products and product purchases may be available via the Online Sites. These transactions or interactions will be instigated by you either as a guest or logged on to the RACT Member Hub.

Whether you are transacting as a guest or logged on to the RACT Member Hub in completing such an interaction online you will be required to provide personal information to the RACT Group. You will be directed to our privacy policy as part of any process whereby you provide personal information, however reference should be made to our policy in relation to online cookies and further details on our privacy policy elsewhere in these terms.

These online terms do not replace individual product, renewal or payment terms and conditions which you will be directed to as part of the particular application or purchase process you undertake. In the case of the financial services or credit services available through the RACT Group we are required to provide you with additional information prior to completion of your application or transaction that do not form part of these online terms. Where applicable you will be directed to the RACT Group’s Financial Services Guide, Credit Services Guide and Product Disclosure Statements and you must confirm receipt of the same to complete the relevant application or transaction.

No Advice

The Online Sites do not purport to provide you with financial product or investment advice of any kind. The information available via the Online Sites does not take account of your particular financial or insurance position or requirements. The RACT Group recommend that you seek independent advice before acting upon any information on the Online Sites or any other website.

Passwords and Authority

You are responsible for the security and confidentiality of your personal information and any login or passwords other than respect to the storage of this information by the RACT Group.

We may treat and act on any online interaction or transaction that purports to be made by you through the provision of personal information via the Online Sites as authentic and we are under no obligation to investigate the authenticity or authority of persons undertaking the interaction or transaction or to verify the accuracy and completeness of the same.

Updating Personal Details Online

The RACT Group may provide the ability for you to update your personal information through the Online Sites. Unless and until expressly advised otherwise these amended details should not be taken to have been amended across your product holdings with the RACT Group.

Copyright, Trade Marks and Intellectual Property Rights

The Online Sites and all material provided on the Online Sites are owned or licensed by the RACT Group. The appearance of the Online Sites including (without limitation) all graphical elements, audio effects, visual features, colour combinations and layout is owned by RACT. Except where necessary for viewing the material on the Online Sites on your browser, or as permitted under the Copyright Act 1968 or other applicable laws or these online terms, nothing on the Online SItes may be reproduced, adapted, uploaded to a third party, linked to, framed, performed in public, distributed or transmitted in any form by any process without the prior written consent of RACT.

Various trade marks or other intellectual property displayed on the Online SItes may be owned by RACT. Other product and company RACT mentions on the Online Sites may be the trade marks or intellectual property of other people or entities reproduced on the Online Sites by permission of the owners to RACT.

These trade marks should not be used or reproduced by you or another party without the permission of the relevant owners. If you believe you own the copyright in any work and that work is displayed on the Online Sites without your permission, please contact us and the matter will be investigated.

Any submission on the Online Sites including (without limitation) submissions to social media sites operated by the RACT Group and your agreement to these online terms shall constitute an assignment to RACT of any intellectual property rights. Whenever you make use of a feature that allows you to upload material to the Online SItes, including questions, or to make contact with other users of the Online Sites or to make submissions on any third party site or page, you must comply with the content standards set out below and these terms. Any third-party advertising on the Online Sites including (without limitation) on RACT pages on third party social networking sites are not endorsed by or the responsibility of RACT. All rights, including copyright on the Online Sites and RACT pages are owned by or licensed to RACT. Any use of any RACT social networking pages or their contents, including copying or storing them in whole or in part, other than for your own personal, non-commercial use is prohibited without the permission of RACT. External Websites

The Online Sites may contain links to third party sites due to service provision by other entities to RACT, advertising (which includes links to Royal reward Partners) or may appear as a result of your browser settings. RACT is not responsible for the operation or content of any third party websites and you access those sites and/or use those sites at your own risk. As a result these online terms will not apply to those third party websites.

Where the third party websites relate to service providers that provide products or services to our members with our approval the websites may be framed with RACT material and regardless we will ensure that we advise or otherwise make clear when you are no longer on websites that are under RACT Group control. It is your responsibility to satisfy yourself that you accept any terms of use that may apply to those third party websites.

Privacy and Cookies

Your privacy and security is important to the RACT Group. RACT’s Privacy Policy will help you understand how RACT collects, uses, discloses, holds and safeguards your personal information. This includes personal information actively provided by you to us through specific interactions or transactions with us including through the Online Sites, during which you will be asked to confirm your receipt of RACT’s Privacy Policy.

In addition our Online Sites utilise cookies and other technical mechanisms to store information that your browser stores on your computer. These assist us to improve and develop products, services we offer to you and the Online Sites. The information used is not considered personal identifiable information and you may elect to disable cookies on your web browser. Severability

If any of these terms are determined to be illegal, invalid or otherwise unenforceable by reason of the laws of any state or country in which these terms are intended to be effective, then to the extent and within the jurisdiction in which that term is illegal, invalid or unenforceable, it shall be severed and deleted from these terms and the remaining terms shall survive and continue to be binding and enforceable.

Waiver

The failure or delay of the RACT Group to exercise or enforce any right in these terms does not waive the RACT Group's right to enforce that right.

Applicable law

The information on the Online Sites shall be governed by and construed in accordance with the laws of the state of Tasmania, Australia.
