Driver Training Terms & Conditions

Customer Agreement 

The following terms and conditions represent the basis upon which driving lessons and P1 assessments are offered by RACT Driver Training. By booking a lesson or P1 assessment with RACT Driver Training, you are entering into this agreement and are bound by the following terms. 

These terms and conditions are governed by the laws of Tasmania, Australia. RACT reserves the right to vary these terms and conditions at any time. Where you have already accepted these terms, we will use reasonable endeavours to ensure that you are not materially adversely affected by variations. 

Service Availability and Locations 

Lesson Availability 

We conduct driving lessons and P1 assessments at RACT's designated locations across Tasmania. Bookings are required for all lessons and can be made: 

  • Online at www.ract.com.au 

  • By calling 13 27 22 

  • By visiting your nearest RACT branch 

The availability of your lessons is sometimes subject to change. We will notify you at the first available opportunity if there is a change that will impact your next appointment(s). 

Training Locations 

All driving lessons and assessments will start and finish at a designated RACT Driver Training location. You will be asked to nominate a preferred location when making your booking. 

In some cases, we may agree to an alternative pick-up and drop-off location if requested at the time of booking. 

Depending on your experience level and confidence, the instructor may need to drive you to a safer location with less traffic before your lesson commences. If required, this travel time is included in the total duration of your driving lesson. 

Agency On-Site Services: For agency bookings, RACT may provide on-site training at agency premises or alternative locations as agreed. Pick-up and drop-off services may be available within agreed areas. 

Lesson Requirements 

Driver's Licences 

It is a legal requirement that you hold a current licence to drive on Tasmanian roads. This includes learner or provisional licences, or international licences where requirements are met. You must bring your driver's licence to every lesson for verification by your instructor. 

For international driving licences, you must provide an English translation of your driver's licence as legally required. 

Fitness to Drive 

Before commencing any lesson or assessment, you must be in a fit state to drive. This includes complying with any legal or medical requirements applicable to your circumstances. RACT is committed to providing a safe environment for customers, staff, and other road users. 

RACT reserves the right to refuse to proceed with a lesson if we reasonably believe you are not fit to participate in driving instruction or assessment. 

It is unlawful in Australia to drive whilst under the influence of alcohol or illegal substances. 

You must always comply with relevant road rules, driver's licence restrictions or conditions, and any driving instructions provided by your instructor. 

Appropriate Footwear 

Appropriate footwear must be worn for driving lessons. We highly recommend flat, enclosed shoes. Some footwear (high heels, thongs) may create safety risks when using vehicle pedals and controls. 

Your driving instructor will advise you if they believe there is a potential safety risk, which may lead to lesson cancellation and full fee forfeited. 

Punctuality and Attendance 

You must be ready to commence your lesson or your P1 assessment 15 minutes prior to the agreed time. If you arrive late, your instructor will wait up to 15 minutes and may deduct this time from your total lesson duration. If you arrive more than 15 minutes late, your instructor may choose not to proceed with the lesson, and you will forfeit the lesson fee. 

Electronic Device Policy 

Mobile phones and other electronic devices must not be a distraction while driving.  We ask that devices be switched to silent or turned off and stored out of eye-sight during the lesson. 

Vehicle Provisions 

RACT Training Vehicles 

RACT Driver Training ensures all vehicles are fitted with essential safety features including: 

  • ABS (anti-lock braking system) 

  • ESC (Electronic Stability Control) 

  • Dual passenger controls 

All RACT vehicles meet Public Passenger Vehicle Inspection safety and roadworthiness requirements. 

RACT training vehicles may contain global positioning and monitoring systems to identify vehicle location and operational manner. 

In-Car Camera Policy 

Driving Lessons 

RACT may use in-car cameras for on-road driving lessons and P1 assessments to enhance safety for customers and staff. 

The cameras support us by: 

  • Improving safety outcomes during driving lessons 

  • Providing evidence for police reports and insurance claims in case of incidents 

  • Supporting workplace health and safety claims and complaint handling 

  • Enabling quality assurance audits to ensure staff follow procedures and standards 

All footage is treated confidentially, becomes RACT property, and will not be disclosed to third parties unless you consent or it's authorised by law. 

Before commencing lessons in camera-equipped vehicles you will be advised of the recording and asked to complete and sign a camera recording consent form.   We may not be able to fulfill your lesson if you do not provide consent. 

P1 Assessments 

RACT is an authorised P1 driving assessment provider delivering assessments on behalf of the Department of State Growth. 

As an authorised provider, we are required to record camera footage during P1 assessments and provide this to State Growth. All students must complete a consent form before assessment. If you don't complete the consent form, we cannot conduct the assessment, you will be marked as having failed the P1 assessment, and no refund will be issued. 

Assessment footage becomes the property of State Growth, subject to the Personal Information Protection Act 2004 and Vehicle and Traffic Act 1999. RACT cannot access this footage. To access footage, contact State Growth at [email protected]

RACT accepts no liability for consequences of camera equipment not being operational, including requirements to repeat assessments. 

Payments and Bookings 

Payment Requirements 

Payment must be made and confirmed to reserve bookings. Once payment is received, we provide email confirmation along with a copy of your purchase. Physical invoices are available upon request for branch bookings. 

Payment Methods: 

  • Online via Customer Booking Portal 

  • Phone payments on 13 27 22 

  • At RACT branches 

  • Acceptable: Credit cards (MasterCard, Visa) and debit cards 

  • Not accepted: Cash, AMEX, or Diners Cards 

Contract Formation: No contract is formed until RACT accepts your booking by providing confirmation. RACT reserves the right to reject bookings for any reason. 

Agency Bookings 

For participants booked through employment or training agencies, payment is made directly by the agency. Participants are not required to make individual payments where covered under an agency agreement. 

The agency is responsible for providing cancellation notice on behalf of participants. Standard cancellation timeframes and fees apply. 

Cancellations and Refunds 

Driving Lessons 

We require at least 24 hours' notice to cancel or reschedule lessons. Contact our customer service team on 13 27 22 or online at www.ract.com.au

If you don't provide 24 hours' notice, we cannot cancel or change your lesson, resulting in forfeiture of the lesson fee. This includes students failing to attend scheduled appointments. 

You may forfeit your lesson (without refund) if you don't have your current driver's licence or are in breach of licence conditions. 

P1 Assessments 

  • More than 5 business days' notice: Can be transferred to a future date without penalty 

  • Within 5 business days: Can be transferred subject to $50 administration fee 

  • Within 24 hours: No refunds available, full fee forfeiture 

RACT-Initiated Changes 

RACT may need to cancel, postpone, or change lesson duration due to: 

  • Instructor illness 

  • Vehicle unavailability due to circumstances beyond our control 

  • Dangerous weather events 

  • Significant traffic or road incidents 

When this occurs, we will inform you as soon as possible and endeavour to find an alternative appointment. If your instructor becomes unavailable, we will provide an alternative instructor where possible. 

Instructor's Right to Terminate 

Instructors reserve the right to terminate lessons immediately if they have reasonable grounds to believe continuing would represent a safety risk. No refund is provided in these situations. This includes circumstances where instructors reasonably believe the student is under the influence of alcohol or drugs, or fails to follow instructor directions. 

Lesson Packages and Benefits 

Package Expiry 

Lesson packages, gift vouchers, and credits are transferable but non-refundable for cash or other RACT products. They must be used within 3 years from purchase date. 

Transfers 

Valid and unexpired lesson packages may be transferred to immediate and close family members upon request. RACT will convert credit into lesson vouchers equal to the original amount paid. Lesson and voucher prices are subject to change, and additional charges may apply if required. 

Transfer processing takes 2 business days. Transferred lessons retain their original expiry date.  Lesson packages may only be transferred to another person once and cannot be transferred again after the initial transfer. 

Membership Benefits 

3+ Lessons : Purchase three lessons or more and be eligible for Lifestyle Membership with exclusive benefits. 

7+ Lessons : Purchase seven lessons or more and be eligible for free 12-month RACT Roadside Advantage membership after successfully obtaining your P1 Driver's Licence. 

Both offers must be redeemed within 3 months of package purchase and/or after successfully obtaining your P1 Driver's Licence. 

P1 Assessment Information 

Pre-Assessment Requirements 

Arrive 15 minutes prior to your scheduled assessment to allow your Driving Assessor to verify eligibility requirements, including: 

  • Valid driver's licence 

  • Completed logbook hours 

  • Any required exemption letters from Department of State Growth 

  • Completed your Hazard Perception Test via PlatesPlus 

If you don't meet eligibility requirements, you will be deemed to have failed your P1 assessment and forfeit the fee paid.

Online Portal Terms 

Booking Portal Usage 

When using the RACT online booking system, you must: 

  • Use your own credentials and not share them with anyone 

  • Provide current, accurate, and complete information 

  • Update details when required 

Prohibited Activities 

The booking portal must not be used for: 

  • Illegal activities or inappropriate content 

  • Accessing other users' accounts or information 

  • Interfering with portal operation or structure 

Liability and Legal Protection 

Limitation of Liability 

Except for liability that cannot be excluded by law or caused by our negligence, RACT, our related entities, officers, employees, contractors, and agents shall not be liable for any loss, damage, liability, or personal injury (including indirect or consequential loss) arising from: 

  • Your participation in driving lessons or assessments 

  • Your failure to follow reasonable instructor directions 

  • Assessment that you are unfit or unsafe to drive 

  • Termination of lessons under these terms 

  • Continuing to drive after being assessed as unfit or unsafe 

  • Your breach of these terms and conditions 

Indemnity 

You agree to indemnify RACT and our related entities, officers, employees, contractors, and agents against any loss, damage, liability, costs, and expenses arising from: 

  • Your breach of these terms and conditions 

  • Your participation in the driver training programme 

  • Traffic infringement notices incurred during lessons 

  • Cleaning fees (up to $200) if RACT vehicle interiors require cleaning due to your actions 

  • Damage to RACT vehicles beyond normal wear and tear not covered by insurance 

  • Insurance excess applicable to claims whilst you are driving 

  • Government fees associated with test cancellations you cause 

Property Disclaimer 

RACT accepts no liability for personal property left in any RACT vehicle, customer vehicle, or on RACT premises. 

Intellectual Property 

RACT owns all intellectual property rights in training materials, assessment forms, and course content provided during lessons and assessments. Any materials created during your training programme, including modifications or improvements to RACT materials, become RACT property. 

You may not reproduce, distribute, or use RACT training materials for commercial purposes without written consent. 

Warranties and Disclaimers 

RACT Warranties 

RACT warrants that: 

  • Driver training services meet applicable approved standards 

  • All instructors hold current motor driving instructor licences issued by Tasmanian authorities 

  • Training vehicles meet required safety and roadworthiness requirements 

Disclaimer of Warranties 

RACT makes no warranty regarding: 

  • Instructor information accuracy displayed online 

  • Driving assessment results or competency outcomes 

  • Successful completion of external tests or assessments 

  • That training guarantees passing any driving test 

Other than warranties that cannot be excluded by law (including Australian Consumer Law guarantees), all other warranties are excluded. Where warranties cannot be excluded, RACT's liability is limited to re-supplying the service or refunding the service cost. 

Termination of Services 

RACT may immediately terminate or suspend your participation in driver training services if you: 

  • Breach these terms and conditions 

  • Cease to hold a valid driver's licence 

  •  Engage in behaviour creating safety risks or threatening staff 

Privacy and Information 

Privacy Statement 

Our Privacy Policy contains information about how RACT collects and uses personal information, how you can access and correct your information, raise concerns or complaints, and when we may collect information from third parties. 

For agency bookings, participant information including attendance and results may be shared with the referring agency subject to participant consent.

Terms of Use 

RACT reserves the right to change these conditions from time to time. These terms and conditions form part of the agreement between the customer and RACT Driver Training. 

Making a booking for or attending a Driver Training lesson or P1 assessment with us constitutes acceptance of these terms and conditions.  Where a booking is made on behalf of another person, we rely on you informing them of these terms and conditions.

Severability 

If any part of these terms and conditions is found invalid or unenforceable, the remaining provisions continue in full force and effect.
